These Terms are between the customer purchasing AI Reader for Moodle ("Customer", "you") and the plugin provider ("Provider", "we", "us").

These Terms apply to purchases of AI Reader for Moodle through Moodle Marketplace or directly from the Provider. By purchasing, renewing, downloading, installing, or using a paid plan for AI Reader for Moodle, you agree to these Terms.

AI Reader for Moodle is intended for organizations and professional use. It is not intended for sale to consumers acting primarily for personal, family, or household use.

AI Reader for Moodle is distributed for use with Moodle and is licensed under the GNU General Public License version 3 or later, unless a file states a different compatible license.

These commercial Terms apply to paid Marketplace access, updates, support, warranty, onboarding, and related services. They do not remove or limit any rights that you receive under the applicable open source license for GPL-covered code, including the right to inspect, modify, and redistribute that code under the GPL.

Prices are shown in the applicable product listing, quote, invoice, or order form. Unless otherwise stated, paid plans are licensed per Moodle site and billed annually.

Payments are processed through the payment provider used by Moodle Marketplace or by the Provider's invoice/payment processor. Prices are exclusive of taxes unless expressly stated otherwise.

The Customer is responsible for all applicable taxes, duties, or governmental charges, except taxes based on the Provider's income.

Subscriptions renew according to the Marketplace listing, order form, or invoice terms. If automatic renewal is enabled, the Customer is responsible for cancelling before the renewal date to avoid renewal charges.

AI Reader for Moodle requires an OpenAI API key or compatible text-to-speech/translation gateway configured by the Moodle site administrator. Unless the applicable order form states otherwise, the Customer is solely responsible for obtaining, configuring, securing, and paying for any third-party API account, API usage, gateway, proxy, hosting, bandwidth, or infrastructure costs.

The Provider does not control third-party API prices, model availability, outages, rate limits, billing policies, or terms of service.

Paid support covers reasonable assistance with installation, configuration, plugin defects, compatibility questions, and documented features for supported Moodle versions.

Support does not include Moodle hosting, unrelated Moodle administration, custom development, third-party API billing disputes, modified plugin code, custom themes, or conflicts caused by unrelated plugins unless included in a separate written agreement.

Updates are provided for active paid subscriptions according to the purchased plan. The Provider may change, add, or remove features in future versions to improve security, reliability, compatibility, or maintainability.

The Customer may cancel a subscription according to the process provided by Moodle Marketplace or the applicable payment processor. Cancellation prevents future renewal charges but does not automatically refund fees already paid.

Unless required by law or stated in a separate written agreement, fees are non-refundable after purchase. At the Provider's discretion, the Provider may issue a refund for duplicate purchases, accidental renewals reported promptly, or unresolved installation-blocking defects reported within 14 days of the initial purchase.

Refunds do not cover third-party API charges, hosting costs, implementation fees, consulting fees, or custom development work already performed.

The Customer is responsible for:

• Installing and operating Moodle and required server infrastructure.
• Running Moodle cron and maintaining supported Moodle/PHP/database versions.
• Configuring API keys, gateway endpoints, privacy settings, and cost caps.
• Ensuring that use of AI-generated narration complies with the Customer's policies and laws.
• Backing up the Moodle site before installation, upgrade, or configuration changes.

AI Reader for Moodle sends cleaned course activity text to the configured text-to-speech, translation, and optional alignment endpoints. The plugin is designed not to send Moodle user identifiers, names, email addresses, or user IDs to those external APIs.

The Customer remains responsible for its Moodle site's privacy notices, legal basis for processing, data processing agreements with third-party API providers, and compliance with applicable privacy and accessibility requirements.

To the maximum extent permitted by law, AI Reader for Moodle and related services are provided "as is" and "as available." The Provider disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.

To the maximum extent permitted by law, the Provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or procurement of substitute services.

To the maximum extent permitted by law, the Provider's total liability for all claims relating to the product or these Terms is limited to the amount paid by the Customer to the Provider for AI Reader for Moodle during the 12 months before the event giving rise to the claim.

The Provider may suspend or terminate paid support, updates, Marketplace access, or related services if the Customer fails to pay, materially breaches these Terms, abuses support, violates applicable law, or misuses the product or services. Termination of paid services does not remove rights already granted under the applicable open source license for copies of GPL-covered code already received by the Customer.

The Provider may update these Terms from time to time. Updated Terms apply to purchases, renewals, and services after the updated effective date. Material changes will be posted on this page or communicated through the applicable Marketplace, invoice, or support channel.

These Terms are governed by the laws of Missouri, United States, excluding its conflict-of-law rules. The state or federal courts located in Missouri, United States will have exclusive jurisdiction for disputes relating to these Terms, unless applicable law requires otherwise.
